These Terms of Use apply to the internet websites and mobile applications (collectively, the “Sites”) owned and operated by K-LOVE, Inc. (including through its brands, Air1, AccessMore, K-LOVE ON DEMAND (KLOD), and others, and its affiliated companies, including but not limited to, Educational Media Foundation, WTA Media LLC, The Association for Community Education, Inc. (Radio Nueva Vida) (collectively, ("K-LOVE,” “we,” “us,” or “our”). Through our Sites, K-LOVE operates electronic platforms/systems including web and mobile applications that enable our audiences and listeners to access and use certain K-LOVE online products and services (collectively, the "Services"). IF YOU ACCESS OR USE OUR SITES OR SERVICES, YOU AGREE TO THESE TERMS OF USE.

CONTENT

The Sites and Services, and all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code contained or displayed therein (collectively, the “Content”), including but not limited to the design, structure, selection, coordination, expression, "look and feel", and arrangement of such Content, contained on the Sites and Services, are for your personal, non-commercial use, and are intended for informational and entertainment purposes only. The Sites, Services, and Content are owned, controlled, or licensed by or to K-LOVE, and are protected by trade dress, copyright, patent, and trademark laws, and various other intellectual property rights and unfair competition laws. Except as expressly provided in these Terms of Use, no part of the Sites, Services, or Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way, without K-LOVE’s express prior written consent.

YOUR USE OF THE SERVICES

You shall not knowingly introduce a virus or other harmful component, or otherwise tamper with, impair or damage any Site or Service or connected network, or interfere with any person or entity’s use or enjoyment of any Site or Service. You may not probe, scan or test the vulnerability of the Services or any network connected to the Services, nor breach the security or authentication measures on the Services or any network connected to the Services.

In order to access and use some of the Services, you will be required to register on our Sites. If you register on any Sites, keep the username and password you create upon registration private and do not allow others to access the Sites and Services under your name or in violation of these Terms of Use.

You may not use the Sites or Services or any Content for any purpose that is unlawful or prohibited by these Terms of Use. K-LOVE may, in its sole discretion and without prior notice, terminate your access to the Sites or Services and/or block your future access to the Sites or Services if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Sites or Services.

USER GENERATED CONTENT AND INTERACTIVE AREAS

Some of the Services may allow you to submit content ("User Generated Content") which may be accessible and viewable by the public, including blog comment posting areas, reader photo or video uploads, SMS text messaging, and mobile alerts. You may not submit or upload User Generated Content that is defamatory, harassing, threatening, bigoted, hateful, violent, vulgar, obscene, pornographic, or otherwise offensive or that harms or can reasonably be expected to harm any person or entity, whether or not such material is protected by law, or which infringes on the intellectual property rights of K-LOVE or any third party. If K-LOVE suffers harm or losses because of any User Generated Content you uploaded to any Site or Service, you are responsible for compensating K-LOVE for such harm or losses, and you indemnify and hold K-LOVE, our subsidiary and affiliated companies, and each of their respective employees, officers, directors, members, and agents harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees), made against us by any third party arising out of or in connection with our use and exploitation of your User Generated Content.

CONTESTS; OTHER TERMS AND CONDITIONS

Additional terms and conditions may apply to specific portions or features of the Services, including SMS text messaging features, contests, promotions or other similar features, all of which terms are made a part of these Terms of Use by this reference. You shall abide by such other terms and conditions, including, where applicable, representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of the Services, the latter terms shall control with respect to your use of that portion of the specific Service.

EXTERNAL LINKS TO OTHER SITES

The Sites and Services may contain links to third-party websites ("External Sites"), which are not under K-LOVE’s control. K-LOVE has no responsibility for any External Sites or your use of them.

DISCLAIMERS

K-LOVE DOES NOT PROMISE THAT THE SITES, THE SERVICES, ANY CONTENT, OR ANY FEATURE OF THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITES AND SERVICES WILL PROVIDE SPECIFIC RESULTS. THE SITES, SERVICES, AND THE CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. ALL INFORMATION PROVIDED ON THE SITES AND SERVICES IS SUBJECT TO CHANGE WITHOUT NOTICE. K-LOVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

GOVERNING LAW; DISPUTE RESOLUTION

You agree that all matters relating to your access to or use of the Sites or Services, including all disputes, will be governed by the laws of the United States and by the laws of the State of Tennessee without regard to its conflicts of laws provisions.

VOID WHERE PROHIBITED

K-LOVE administers and operates the Sites and Services from its locations in the United States. Although the Sites and Services are accessible worldwide, not all features, products, or services discussed, referenced, provided, or offered through or on the Sites and Services are available to all persons or in all geographic locations, or appropriate or available for use outside the United States. If you choose to access the Sites or Services from outside the United States, you do so on your own initiative and you are solely responsible for complying with applicable local laws.

MOBILE TERMS AND CONDITIONS 

1. There is no fee from K-LOVE to receive text messages. Message and data rates may apply- this can be checked with your mobile service provider. Charges are billed and payable to your mobile service provider or deducted from your prepaid account. Consent is not a requirement for purchase.
2. Data obtained from you in connection with this SMS service may include your mobile phone number, your carrier’s name and the date, time and content of your messages. We may use this information to contact you and provide the services you request from us. Alerts sent via SMS may not be delivered if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless operator may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather. Wireless operators do not guarantee message delivery and will not be held liable for delayed or undelivered messages.
3. We will not be liable for any delays in the receipt of any SMS message as delivery is subject to effective transmission from your network operator.
4. By subscribing to K-LOVE mobile alerts, the user consents to receive automated updates on new music, videos, contests, donation opportunities and other notifications via text message. Message frequency varies. Message & data may apply.
